Unless otherwise stated, the following applies to all processing shown:

2.1.1 No obligation to provide

There is no legal obligation to provide personal data. You are not required to be data controllers.

2.1.2 Consequences of non-provision

If data is required (data that are marked as mandatory when entered), the failure to provide the service in question may not be performed. Otherwise, the non-provision may mean that our services cannot be provided in the same form and quality.

2.4 Application

A wide range of career opportunities exist within our group of companies. In an ongoing application process, we process your personal data in the following ways:

We store your application documents with all the information you provide in them in the application pool of the PIA group of companies (https://pia.me ). The PIA companies use the application pool to find suitable candidates for vacant positions. Your data will be deleted 6 months after inclusion in the application pool or, in the case of consideration in a selection process, 6 months after completion of the selection process. Your application documents will only be passed on within the PIA group of companies; they will not be passed on to third parties.

You have the right to find out whether we are processing personal data concerning you, what personal data this may be, and further information in accordance with Art. 15 GDPR.

3.3 Right to rectification

You have the right to request us to correct any incorrect personal data relating to you without delay (Art. 16 GDPR). Taking into account the purposes of the processing, you have the right to request the completion of incomplete personal data – including by means of a supplementary declaration

3.4 Right to deletion („right to be forgotten“)

You have the right to demand that we delete personal data concerning you immediately if one of the reasons stated in Art. 17 Para. 1 GDPR applies and the processing is not for one of the reasons in Art. 17 Para. 3 DS -GVO regulated purposes is required.

3.5 Right to restriction of processing

You are entitled to request a restriction in the processing of your personal data if one of the conditions set out in Art. 18 Para. 1 Letters a) to d) of the GDPR is met.

You have the right to receive the personal data concerning you that you have provided to us in a structured, common and machine-readable format. 1. Wie werden die E-Mail-Adressen generiert?

Für den Versand des E-Mail-Marketings nutzen wir ein Partnernetzwerk aus mehr als 30 Versendern, die Adressen aus Online-Gewinnspielen, Umfragen und Contentportalen generieren. Diese Adressen werden bereits beim Ausfüllen vom User mit Merkmalen versehen. Anschließend senden die Versender dann themenspezifische Newsletter mit Umfragen, um die Adressen weiter zu clustern.

2. Was sind die Rahmenbedingungen für das E-Mail-Marketing bei Euch?

Alle von uns genutzten Adressen sind Double-Opt-In bestätigt, sodass jeder User zuvor ein Werbeverständnis abgegeben hat, bevor dieser angeschrieben wird. Zudem arbeiten wir mit strengen Vertragsbedingungen unter denen die Versender die Haftung für den Versand sowie den Einsatz der Adressen verwalten. Bei einer User-Beschwerde übernehmen wir mit dem Versender das Beschwerdemanagement und können auf Wunsch den Nachweis des Double-Opt-Ins innerhalb von kurzer Zeit anfordern und vorlegen lassen. Alle Faktoren halten wir entsprechend in unseren Buchungsbedingungen fest.

3. Was ist ein SOI und was ein DOI?

Bei einem SOI also Single-Opt-In handelt es sich um Benutzer, die lediglich ihre einmalige Zustimmung gegeben haben, sich auf einer Mailingliste zu registrieren, ohne ihre Anmeldung bestätigen zu müssen. Bei einem DOI, Double-Opt-In wird ein User aufgefordert, nach der Registrierung auf einer Mailingliste, diesen Vorgang nochmals zu verifizieren. Nach der Bestätigung des Users ist gewährleistet, dass dieser Interesse am Erhalt von E-Mail-Marketing hat. In Deutschland ist nur die Double-Opt-In Variante gesetzlich erlaubt. Aus diesem Grund ist jeder unserer Versender verpflichtet den DOI nachzuweisen.

1. Welche rechtlichen Aspekte muss ich beim E-Mail-Marketing beachten (z. B. DSGVO)?

Der E-Mail-Versand ist in Deutschland ohne Probleme erlaubt, solange ein paar Regeln eingehalten werden. Am wichtigsten ist hierbei die Werbeeinwilligung des Kunden. Diese ist laut Rechtsprechung nur beim Double-Opt-In (DOI) Verfahren gewährleistet. Das bedeutet der Kunde muss nach der Anmeldung noch die Bestätigungsmail akzeptieren, damit ein Versehen ausgeschlossen werden kann. Dazu muss die Datenverarbeitung transparent einsehbar sein, ein Widerrufsrecht bestehen und jederzeit Abmeldeoptionen bereitgestellt werden. Für die Produkte Alkohol, Tabak und Glücksspiel gelten unterschiedliche Gesetze, diese müssten von Fall zu Fall bewertet werden.

2. Wie läuft die Handhabung bei Beschwerdefällen von Nutzern ab?

Sobald ein DOI-Beschwerdefall auffällt, übernehmen wir das Beschwerdemanagement und kümmern uns um die Kommunikation zwischen Kunde und Versandpartner. Da unsere Ver-sandpartner auf Basis unserer AGBs rechtlich nur User mit einem vorhandenen DOI ansch-reiben dürfen, haben wir hier die Basis, um den jeweiligen Fall lösen zu können.

3. Wer ist der Absender der Newsletter?

Als Kunde agiert man nicht als Versender/Absender des Mailings, sondern wird von der rechtlichen Seite als Anzeigeninserent eingestuft. Der Versender wird als Absender deutlich durch seine E-Mail-Adresse sowie dem Header und Footer der verwendeten E-Mail-Liste. Im Footer hat der Empfänger stets die Möglichkeit sich per Abmeldelink von den Newslettern abzumelden und Fragen zur Herkunft und Speicherung seiner Daten zu stellen. Vor Versandstart prüfen wir technisch die Vollständigkeit des Trackings und visuell die Darstellung der Testmails inklusive Impressum und direkter Kontaktmöglichkeit des Versenders.
